Shanghai implements architect-led system in Pudong New Area

Shanghai's legislative authority has passed a set of regulations, outlining a new framework for the implementation of an architect-led system in the city's Pudong New Area.

The regulations, effective from Jan 1, 2025, were approved by the Standing Committee of the 16th Shanghai Municipal People's Congress during its 17th session on Nov 28. They aim to bolster the role of architects throughout the construction process, aiming to elevate both construction quality and architectural aesthetics.

The architect-led system, as defined by the regulations, mandates that the lead architect, who holds the position of chief design director or manager, assumes the responsibility of forming and overseeing a dedicated team within their design firm. The team will provide comprehensive services to construction entities, encompassing design, technical consulting and project management throughout the construction lifecycle.

The new regulations delineate specific project categories, funded in part or in whole by the Pudong New Area government, which will fall under the new architect-led system. These include new construction projects in education, research, culture, healthcare and sports that meet certain scale criteria; restoration projects involving historically significant buildings; and construction projects with unique architectural or functional requirements.

The regulations also establish a framework for selecting and contracting lead architects, outlining their qualifications, responsibilities and involvement throughout the various phases of a project. It emphasizes collaboration between the architect-led team, construction units and relevant government departments to ensure the smooth execution of the project.

To facilitate the new system, the regulations call for the simplification of administrative procedures and optimization of approval processes for projects adopting the architect-led approach.

Furthermore, the regulations address aspects like service fee structures, insurance options and accountability measures for architects and construction entities, including provisions for penalties in case of violations or professional misconduct.
